Rumor Busters – First time H1B Visa stamping in Canada from other visa status (F1, L1, and H4)?

We have been hearing about H1B Visa applicants (from F1, L1, H4 etc Visas) being routed to their home country when they go for their first time H1B stamping in Canada.

I have heard some people say this and also saw online on many forums about it but at the same time I know some of my friends who went to Canada during same time period and got their stamping done successfully. This made me to find the truth in the rumor on whether consulates in Canada and Mexico are really routing people to their home countries when they go for their first time stamping.

 

Below is an email confirmation which I got from Vancouver Consulate who didn’t say anything about routing to their home countries. They just mentioned about the routine procedures/rules which of course we see on their website all the time.

 

So with this confirmation we can inevitably say that this news about routing first time H1B Visa applicants to their home countries is baseless .Its just a rumor!!!

Note: There will be always some cases which they will route to India due to lack of evidence on their transcripts/documents authenticity, but 99% times, it’s a straight forward issue.

I would like to confirm something which I have been hearing from many people now a days about the H1B Visa Stamping. I am on F1 Visa right now and have got an appointment next month for my H1B stamping (I got H1B approval in 2007, since then I haven’t left the country) in Vancouver. This is my first time stamping on H1B status, I have heard that for this kind of Visa stampings I should be going to my home country, is this true? I didn’t read anywhere you your website about this rule. Please confirm if that’s true?

Thank you for your inquiry.  Anyone physically present in our consular district (British Columbia and the Yukon) may apply for a U.S. visa at the U.S. Consulate in Vancouver. Applicants under the age of 14 must either be normally resident in our consular district, or if not normally resident in our district, must be physically present in the consular district on the day of the visa interview.  An appointment does not guarantee that a visa will be issued.  Each visa application will be adjudicated on its merits.  Visa approval is not assured, and even if otherwise issuable, necessary administrative processing may delay visa issuance to some applicants for anywhere from a few days to several months.  Therefore, before applying for a visa in Vancouver, please give it careful consideration.  Visa applicants are always wise to arrange their affairs with a worst-case scenario in mind.  If you are planning on applying for a visa at our office please e-mail our office a copy of your I-797 as soon as possible so that we can verify the information in advance.  The verification of this information in advance can cause less of a delay in the processing of your case.
